1. Service

Botswe ("the Service") provides an AI chatbot widget that integrates with the merchant's Shopify store to assist visitors with product discovery, FAQs, cart management, and order information. The Service is provided by Botnoos S.r.l..

2. Eligibility

You must operate a legitimate Shopify store and accept these Terms during installation.

3. Subscription & billing

• The Service is offered on a subscription basis (monthly or yearly).
• Pricing is shown in the Shopify App Store and during installation.
• Charges are processed via Shopify Billing API or via Stripe according to the chosen plan.
• You can cancel at any time. No refunds for partial periods.

4. Acceptable use

You agree NOT to use the Service to:

• Send spam, unsolicited messages, or harass visitors.
• Process illegal goods or services.
• Reverse-engineer, scrape, or abuse the API.
• Misrepresent the bot's nature (e.g., claiming it is a human operator).

5. Intellectual property

The Service, including all code, design, AI models, and documentation, remains the property of Botnoos S.r.l. You retain full ownership of your store data, your products, and the conversations of your visitors.

6. Data ownership

• You are the data controller of your visitors' personal data.
• Botswe is the data processor (we process on your behalf, as defined in the Privacy Policy and DPA).
• A Data Processing Agreement (DPA) is available on request from legal@botnoos.com.

7. Service availability

We aim for 99.5% uptime. We are not liable for downtime caused by Shopify, AWS, or other third-party outages, force majeure, or scheduled maintenance announced 24h+ in advance.

8. AI disclaimer

The AI is trained to use your catalog and policies. It can make mistakes. The merchant is responsible for reviewing and configuring the bot's prompt and Knowledge Base. Botswe is not liable for incorrect statements made by the AI; we provide best-effort guardrails.

9. Termination

Either party can terminate at any time. On uninstall:

• The bot stops responding within 1 minute.
• Your access token is invalidated immediately by Shopify.
• All shop data is permanently deleted within 48 hours via Shopify's shop/redact webhook.

10. Limitation of liability

To the fullest extent permitted by law, Botnoos S.r.l.'s liability is limited to the subscription fees paid in the 12 months prior to the event giving rise to liability. We are not liable for lost profits, lost sales, or indirect damages.

11. Governing law

These Terms are governed by the laws of Italy. Any dispute is subject to the exclusive jurisdiction of the courts of Milan, Italy.
